المستخلص

يتناول هذا البحث بالدراسة والتحليل مخدر الشابو المستخلص من مادة الميثامفيتامين (Methamphetamine) من منظور الفقه الإسلامي، باعتباره أحد أخطر أنواع المخدرات الصناعية انتشارًا في العصر الحديث، وتنبع أهمية هذا البحث من خطورة هذا المخدر الذي تتجاوز آثاره حدود تدمير القدرات العقلية والجسدية للفرد، إلى تهديد كيان الأسرة، وزعزعة الأمن المجتمعي، وإفساد النسيج الأخلاقي، وإعاقة مسيرة التنمية الوطنية. ولما كان " حفظ العقل " مقصدًا شرعيًا عظيمًا من مقاصد الشريعة الإسلامية، فإن دراسة هذه الظاهرة تكتسب بعدًا فقهيًا واجتماعيًا بالغ الأهمية، يستدعي بيان الحكم الشرعي لمخدر الشابو في ضوء النصوص القطعية والمقاصد الكلية للشريعة، وربط ذلك بالواقع الطبي والعلمي المعاصر، بما يوضح أثر هذا المخدر على الإنسان والمجتمع. اعتمد البحث على المنهج الوصفي التحليلي الفقهي، القائم على استقراء النصوص الشرعية وأقوال الفقهاء، وتحليلها في ضوء واقع التعاطي والإدمان، مع المقارنة بالحقائق العلمية والطبية المتعلقة بمخدر الشابو، لبيان التكييف الفقهي الصحيح لهذا المخدر في ضوء مقاصد الشريعة الإسلامية؛ لا سيما " مقصد حفظ العقل "، كما تناول البحث الأدلة الشرعية على تحريم هذا المخدر من القرآن الكريم، والسنة النبوية، والإجماع، والقياس، وبيّن العقوبات الشرعية المقررة لتعاطيه، أو ترويجه باعتبارها وسيلة رادعة لحماية العقول، والمجتمعات، كذلك استعرض البحث سبل الوقاية، والعلاج من خلال الجمع بين الردع القانوني، والرعاية النفسية، والاجتماعية، والتوعية الدينية، والإعلامية، تعزيزًا لدور الدولة والمجتمع في مواجهة هذه الآفة الخطيرة. وفي الختام، يؤكد البحث على المسؤولية الجماعية الملقاة على عاتق الأفراد، والمجتمع، ومؤسسات الدولة، في مكافحة ظاهرة تعاطي الشابو، تحقيقًا للمقصد الشرعي الأسمى المتمثل في صيانة العقول، وحماية المجتمع من الفساد والانحراف، وتحقيق التوازن الأخلاقي والاجتماعي المنشود.
Abstract:
This research studies and analyzes the drug Shabu, extracted from the substance Methamphetamine, from the perspective of Islamic jurisprudence, as it is considered one of the most dangerous types of synthetic drugs spreading in the modern era. The importance of this research stems from the danger of this drug, whose effects go beyond destroying the mental and physical abilities of the individual to threatening the entity of the family, destabilizing social security, corrupting the moral fabric, and hindering national development. Since “preservation of the mind” is a great legal objective among the objectives of Islamic law, studying this phenomenon acquires great jurisprudential and social significance, requiring the clarification of the Islamic ruling on Shabu in light of definitive legal texts and the general objectives of Sharia, and linking that to the contemporary medical and scientific reality, to clarify the effect of this drug on humans and society. The research relied on the descriptive, analytical, and jurisprudential method, based on the induction of legal texts and the sayings of jurists, and their analysis in light of the reality of abuse and addiction, with comparison to scientific and medical facts related to Shabu, to determine the correct jurisprudential characterization of this drug in light of the objectives of Islamic law, especially the “objective of preserving the mind.” The research also addressed the legal evidence for the prohibition of this drug from the Holy Qur’an, the Sunnah, consensus, analogy, and the objectives of Sharia, and clarified the legal punishments prescribed for using or promoting it as a deterrent means to protect minds and societies. The research also reviewed methods of prevention and treatment through a combination of legal deterrence, psychological and social care, and religious and media awareness, to enhance the role of the state and society in confronting this dangerous scourge. In conclusion, the research emphasizes the collective responsibility placed upon individuals, society, and state institutions in combating the phenomenon of Shabu abuse, in order to achieve the supreme objective of Sharia represented in preserving minds, protecting society from corruption and deviation, and achieving the desired moral and social balance.
